MyACUVUE® Gamification Campaign

Terms and Conditions

Introduction

MyACUVUE® Gamification is organised by JOHNSON & JOHNSON PTE LTD ("J&J") under the laws of Singapore.

MyACUVUE® Gamification game play & specific rewards redemptions are available at participating optical stores in Singapore only.

Eligibility

MyACUVUE® Gamification game play & rewards redemptions are for ACUVUE® patients. Eye Care Practitioners (ECPs) are disqualified from participating in MyACUVUE® Gamification. ECPs may not avail of MyACUVUE® Gamification prizes and may not accumulate MyACUVUE® membership points which can be used to redeem for MyACUVUE® rewards or lifestyle rewards listed in the MyACUVUE® app.

MyACUVUE® Gamification is only for individuals aged thirteen (13) years or older. If you are thirteen (13) years or older but under the age of eighteen (18) years, you should review these Terms with your parent and/or guardian to make sure that you and your parent and/or guardian understand them.

Agreement

By participating in the MyACUVUE® Gamification, you agree to and shall abide by the terms and conditions and rules and regulations (the “Terms and Rules”) applicable to and governing MyACUVUE® Gamification.

Reservation of Rights

J&J reserves the right at any time and in its absolute discretion to vary the Terms and Rules (or any part thereof) and/or to withdraw or terminate the Contest without prior notice or reason.

All decisions made by J&J in relation to MyACUVUE® Gamification, its Terms and Rules, and any aspect thereof are final and binding and no correspondence will be entertained.

All rewards are:

a. subject to stock availability;

b. not exchangeable for cash or credit unless specifically stated;

c. if unclaimed in accordance with the Terms and Rules, will be dealt with at J&J’s sole discretion; and

d. J&J reserves the right to cancel, change, substitute or remove the said products, goods, items premiums and/or prizes at any time without prior notice.

Privacy Notice

J&J will collect, use, and process your personal information to enable you to participate in MyACUVUE® Gamification and for related administrative services, in accordance with our Privacy Policy at http://www.acuvue.com.sg/myacuvue-privacy-policy. Your personal information will be shared with our affiliates, service providers and partners that we engage to support our business and with which we have contracts in place. Your personal information will be transferred to countries outside of your country of residence which may provide for different data protection rules than in your country. Appropriate contractual and other measures are in place to protect your personal information when it is transferred. We will retain your personal information for as long as needed or permitted in the light of the purpose(s) for which it was obtained. User Data

By participating in MyACUVUE® Gamification, the participants agree to take part in any promotional or publicity exercise as may be conducted by J&J.

Warranty and Use of Records

Each participant warrants that any information provided pursuant to MyACUVUE® Gamification (including but not limited to name, identification number, contact details and number(s) and/or addresses) is true, accurate, valid and to be relied upon by J&J. Each participant shall be responsible for keeping J&J informed of any update to the information initially provided, as necessary.

Each participant hereby irrevocably and unconditionally at no cost, grants J&J all consents and waivers necessary for J&J to make or retain information obtained from MyACUVUE® Gamification and use and/or publish the same in any manner as J&J shall in its sole discretion deem fit.

Where permissible and to the fullest extent permitted by law, each participant expressly waives all rights which the participant may acquire or have or be entitled to under the law (and any subsequent enactment or amendments thereto) in respect of or in relation to, the information obtained from the gamification.

Limitation of Liability

J&J accepts no responsibility and will not be liable for any loss, injury, expense, delay or irregularity (“Loss”) arising out of or in connection with MyACUVUE® Gamification.

J&J disclaims any liability in respect of any Loss (whether suffered by the participants, their families or third parties) arising from or in connection with or as a result of:

a. any incomplete or inaccurate or illegible information provided by the participants;

b. any third parties’ provision of goods and/or services (including but not limited to any communication, delivery or electronic messaging services); and

c. the possession and/or use of the Goods and Services as defined hereafter.

J&J makes no product representation or warranties, expressed or implied and disclaims any and all liability, as to the condition, quality, merchantability or fitness for use of prizes, premiums, goods, products, items and/or services pertaining and/or provided to or received by the participant pursuant to MyACUVUE® Gamification (the “Goods and Services”).

Other Terms

Unless otherwise stated, J&J is under no obligation to contact participants to inform them of their prize redemption. Should J&J choose to do so, we will make only reasonable efforts to contact winning participants.

Any prize collection/redemption must be supported by original identification and any original receipt/document matching the participant’s details. J&J reserves the right to reject participants who at the time of reward collection or redemption, cannot produce the necessary original supporting document(s), or if the supporting document(s) is/are defaced, torn, damaged or illegible.

Participants are to collect and/or redeem their prize within the stated collection/redemption period. J&J reserves the right to forfeit any prize/reward that is not collected and/or redeemed within the aforesaid period.

Where registration is required prior to participation in MyACUVUE® Gamification, each participant shall be responsible for furnishing correct and accurate details.

Participants must utilize the prize/reward and no transfer of name or exchange of the prize for cash, credit or any other kind will be allowed. All prizes/rewards are subject to the issuing or co-ordinating organisations’ terms and conditions as applicable.

Without prejudice and in addition to any term herein, J&J shall not be liable for any loss or claim arising from any delay, error or otherwise arising from any communications, hardware or software failure.

Failure to comply with any of the Terms and Rules of MyACUVUE® Gamification will result in an invalid entry/disqualification.

Without prejudice to any of its other rights, J&J reserves the right to disqualify any participant for fraud and/or reject fraudulent entries as determined in its sole discretion.
